Under international law, there is a Presumption of Continuity of the Hawaiian Kingdom. Thus Hawaiian Kingdom law and the continuation of the Hawaiian State under international law persists, despite intervening events such as the overthrow of its government. Sovereignty is still in tact and remains with Hawai'i as an occupied nation. Therefore, the courts of the 'State of Hawai'i' have no legal jurisdiction.
With regards to this case: Four Molokai men will face arraignment and hearings in Maui Circuit Court later this month after being arrested and charged for their roles in a confrontation between two groups of fishermen in Molokai waters.
